Terms of Use

These Terms of Use ("Terms") apply to your use of the PicRecipeAI mobile application ("App"). The App is operated by an individual developer based in Germany ("we," "our," or "us"). Full contact details are in Section 8.

By using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Age Requirement — 16 and Older

You must be at least 16 years old to use the App.

  • On first launch, the App asks for your age. If you are under 16, the App blocks you from using it.
  • The App relies on the age you enter and has no other way of checking it, so please enter your real age.
  • We do not store your age. The App keeps only a yes/no flag on your device that the check was passed. See our Privacy Policy.

2. What the App Does

The App helps you find ingredients and create recipes. You can give it input as photos, typed text, or voice. The App uses artificial intelligence (OpenAI's API) to detect ingredients and generate recipes, including calorie and macronutrient estimates.

The App has no accounts and no login. Your favorites and preferences are stored only on your device. Your dietary preferences are sent to OpenAI along with your recipe requests.

3. License to Use the App

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for your own personal, non-commercial use. This license is subject to these Terms and to Apple's Standard End User License Agreement.

You may not:

  • Copy, modify, reverse-engineer, or decompile the App, except where the law allows it.
  • Resell, rent, or redistribute the App.
  • Use the App in a way that breaks the law or harms others.
  • Try to get around the age requirement.
  • Overload, abuse, or automate requests to the App's recipe features.

4. Your Content

You keep all rights to the photos, text, and voice input you provide. You give us permission to send this content, together with your dietary preferences, to OpenAI only to detect ingredients and generate the recipes you ask for.

You are responsible for what you submit. Please don't submit:

  • Content that is illegal, offensive, or violates someone else's rights.
  • Photos of other people, or any personal information you don't want to share.

5. AI-Generated Recipes — Please Use Your Own Judgment

Recipes, ingredient detection, and instructions are generated automatically by AI. No person checks them before you see them. They can be wrong.

In particular:

  • Ingredient detection can make mistakes. The App may misidentify or miss ingredients.
  • Always check for allergens yourself. The App may not detect or mention every allergen. If you have a food allergy or intolerance, check every ingredient and product label yourself.
  • Use safe cooking practices. Make sure food is fresh, stored properly, and cooked thoroughly. Don't rely on the App to tell you whether food is safe to eat.
  • Use common sense. If a recipe or step seems wrong or unsafe, don't follow it.

6. Nutrition Estimates — No Medical Advice

Calories and macronutrients (such as protein, carbohydrates, and fat) shown in the App are estimates only. They are generated automatically and may be inaccurate. Actual values depend on the exact products, amounts, and preparation.

The App does not give medical, nutritional, or dietary advice. It is not a substitute for a doctor, dietitian, or other qualified professional. If you have a medical condition, are pregnant, have an eating disorder, follow a medically prescribed diet, or rely on exact nutrition values (for example, for diabetes), please talk to a qualified professional and do not rely on the App's estimates.

7. Price

The App is free to use and has no in-app purchases. If we introduce paid features in the future, we will clearly tell you the price before you pay anything.

9. Availability

The App depends on third-party services, including OpenAI. We try to keep the App working, but we can't guarantee it will always be available or error-free. We may change, update, or discontinue features, or the App itself.

10. Liability

We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body, or health, and wherever liability is required by mandatory law, such as the German Product Liability Act (Produkthaftungsgesetz).

For slight negligence, we are only liable if we breach an essential obligation. An essential obligation is one that is necessary for the App to work properly and that you can reasonably rely on. In that case, our liability is limited to the typical, foreseeable damage.

Because the App is provided free of charge, our liability for defects is limited to cases where we fraudulently concealed them.

We are not responsible for decisions you make based on AI-generated recipes or nutrition estimates, where you ignored the warnings in Sections 5 and 6.

11. Ending Use

You can stop using the App at any time by deleting it from your device. This also deletes your favorites and preferences.

We may block access to the App if you break these Terms or if the law requires it.

12. Changes to These Terms

We may update these Terms if the App or the law changes. We will change the "Last updated" date at the top. For significant changes, we will also let you know in the App.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer living in another country, you still keep any protection that the mandatory laws of your country give you.

If you are a merchant, the courts of Bensheim, Germany have jurisdiction.
