Terms of Service

These Terms of Service ("Terms") govern your use of the Grinde mobile application ("App"), operated by Julia Still Schweder, an individual sole proprietor based in Einhausen, Germany ("we," "our," or "us").

By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Age Requirement — 13 and Older Only

You must be at least 13 years old to use Grinde.

  • On the first launch, you are required to enter your date of birth through a neutral date-of-birth picker. If you are under 13, you will be permanently blocked from creating an account on that device.
  • You confirm that any information you provide about your age is true and accurate.
  • We reserve the right to terminate any account immediately and without notice if we discover or have reasonable grounds to believe the user is under 13. All associated data will be permanently deleted.
  • If you are between 13 and the age of majority in your country, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

To use Grinde, you must create an account using your email address or Sign in with Apple.

You are responsible for:

  • Keeping your login credentials secure.
  • All activity that occurs under your account.
  • Providing accurate information at signup, including your date of birth.

You may not:

  • Create an account using false information.
  • Share your account with another person.
  • Create multiple accounts to abuse the free trial or referral features.
  • Attempt to circumvent the age requirement.

We may suspend or terminate your account at any time if you violate these Terms.

3. License to Use the App

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, solely for your personal, non-commercial use, in accordance with these Terms and Apple's standard End User License Agreement.

You may not:

  • Copy, modify, reverse-engineer, decompile, or disassemble the App.
  • Use the App for any commercial purpose, including but not limited to resale, sublicensing, or competitive analysis.
  • Remove or alter any proprietary notices in the App.
  • Use the App in any way that violates applicable laws or regulations.

4. User Content

You retain ownership of any content you create in the App (such as goals, notes, side quests, and check-ins). By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of operating the App for you.

You are responsible for the content you submit. You agree not to submit content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, or obscene.
  • Infringes any third party's intellectual property or other rights.
  • Contains malware, viruses, or harmful code.

We reserve the right to remove content that violates these Terms.

5. AI-Generated Content

Grinde uses artificial intelligence (specifically OpenAI's gpt-4o-mini model) to generate personalized daily plans and recommendations based on the goal and situation context you provide.

You understand and agree that:

  • AI-generated content is provided "as is" and may contain errors, inaccuracies, or content that is not suitable for your specific situation.
  • We do not guarantee that any plan, recommendation, or advice provided by the App will lead to any specific outcome, including financial success.
  • You are solely responsible for any decisions you make based on the App's content.
  • Grinde is not a substitute for professional financial, legal, medical, or psychological advice. Always consult a qualified professional for important life decisions.

6. Free Trial and Future Paid Features

Grinde currently offers a 10-day free trial of all features. The trial can be extended through the referral system when other users redeem your referral code, or when you redeem theirs.

There is currently no paid tier. We may introduce paid features, subscriptions, or in-app purchases in the future. Any such features will be clearly disclosed before you incur any charges, and all purchases will be processed by Apple under Apple's standard terms of service.

If you are under the age of majority in your country, your parent or legal guardian must consent to any purchases made through your account.

7. Account Deletion

You can delete your account and all associated data at any time directly in the App, through Settings → Delete account.

Deletion is immediate and permanent. There is no grace period and no recovery. Once you confirm, your data is removed from our systems entirely. Please be certain before confirming.

8. No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, error-free, or secure.
  • The results obtained from using the App will be accurate or reliable.
  • Any errors in the App will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR €50 IF YOU HAVE NOT PAID US ANY AMOUNT.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

10. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms.
  • Your misuse of the App.
  • Your violation of any third-party rights.
  • Any false information you provide to us, including misrepresenting your age.

11. Termination

You may stop using the App at any time, including by deleting your account in-app as described in Section 7.

We may suspend or terminate your access to the App immediately, without notice, if:

  • You violate these Terms.
  • We discover you are under 13.
  • We are required to do so by law.
  • We discontinue the App.

Upon termination, your right to use the App ends. Provisions of these Terms that by their nature should survive termination (e.g., liability limits, indemnification, governing law) will continue to apply.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the App or by email. Continued use of the App after the changes take effect constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict of law principles. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Bensheim, Germany, unless mandatory consumer protection laws in your country of residence require otherwise.
